BULTIK.COM TERMS AND CONDITIONS

These Terms and Conditions govern the relationship between Sole Trader “RADKA KISELOVA”, UIC/BULSTAT 122077160, hereinafter referred to as the “Merchant”, on the one hand, and the users of the online store bultik.com, hereinafter referred to as the “Users”, on the other hand.

Please read these Terms and Conditions carefully before using the bultik.com online store and before placing an order.

By placing an order and checking the relevant box to accept the Terms and Conditions, the User declares that they have read, understood, and accepted these Terms and Conditions.

II. SERVICES PROVIDED

Article 1. The services provided through bultik.com constitute information society services within the meaning of applicable Bulgarian legislation.

Article 2. Bultik.com is an online store through which Users can browse the goods offered and enter into contracts for their purchase and sale.

The Merchant has the right to change the product range, availability, prices, promotions, and characteristics of the products offered, without affecting orders that have already been confirmed.

III. REGISTRATION AND PERSONAL DATA

Article 3. To place an order, the User provides the information necessary for processing and fulfilling the order, such as name, telephone number, email address, delivery address or selected delivery office/locker, and other necessary information.

Article 4. The User undertakes to provide accurate, complete, and up-to-date information.

If incorrect, incomplete, or inaccurate information is provided, the Merchant shall not be liable for any inability or delay in processing and delivering the order.

Article 5. Users' personal data is processed in accordance with applicable data protection legislation and the Privacy Policy published on bultik.com.

Personal data for direct marketing purposes is processed only where an applicable legal basis exists.

IV. ORDERS

Article 6. The User places an order using the functionalities of the bultik.com online store.

When placing an order, the User:

  1. selects the desired product;

  2. selects the available product characteristics, such as size, colour, quantity, or variant;

  3. adds the product to the shopping cart;

  4. enters the necessary delivery information;

  5. selects an available delivery method;

  6. selects an available payment method;

  7. reviews the total order value;

  8. accepts the Terms and Conditions and completes the order.

Article 7. After successfully placing an order, the User may receive an electronic confirmation at the email address provided or another notification regarding the status of the order.

Article 8. In the event of lack of availability, a technical error, an obviously incorrect price, or another objective inability to fulfil the order, the Merchant has the right to refuse or cancel the order, informing the User and refunding any amount paid in advance, where applicable.

V. PRICES

Article 9. Product prices are those published on bultik.com at the time the order is placed.

Sole Trader “RADKA KISELOVA” is not registered for VAT.

Article 10. The Merchant has the right to change the prices of the products offered. Such changes do not affect orders that have already been confirmed.

Article 11. Bultik.com may offer promotions, discount codes, and other commercial offers under the conditions specified for the respective promotion.

Unless expressly stated otherwise, different promotional codes and discounts cannot be combined.

VI. PAYMENT

Article 12. The User may use the payment methods available and displayed on bultik.com during checkout.

Depending on the selected delivery method and available options, these may include:

  • payment by bank card;

  • cash on delivery;

  • other payment methods expressly offered in the online store.

Article 13. Where payment is processed through an external payment service provider, the terms and conditions of that provider may also apply to the respective payment transaction.

VII. DELIVERY

Article 14. Orders from Bultik may be delivered through:

  • Econt Express AD;

  • Speedy AD;

  • BOX NOW;

  • Pigeon.

Depending on the selected service, delivery may be made to an address, a courier office, or an automated parcel locker.

Article 15. Where permitted by the relevant courier and delivery service, the shipment may be sent with an “Inspection” service.

In the event of visible damage to the shipment, the User should notify the courier upon receipt and, where necessary, request that the appropriate damage report be prepared.

Article 16. FREE SHIPPING

Bultik offers free shipping for orders worth €69.99 or more, unless otherwise expressly stated for a specific promotion, product, country, or delivery method.

For orders below €69.99, the delivery cost is determined according to the selected courier, delivery method, and applicable rates.

Article 17. Orders are normally processed and dispatched within 2 to 5 business days, unless a different period is specified for the particular product.

Once the shipment has been handed over to the courier, the delivery time depends on the selected provider, destination, and delivery schedule.

Article 18. The Merchant shall not be liable for delays caused by the courier or logistics company or by other circumstances beyond the Merchant's reasonable control.

In the event of a problem, Bultik will assist the User in determining the status of the shipment.

Article 19. The User is required to provide accurate delivery information.

If the User does not collect the shipment within the storage period specified by the relevant courier or operator, the shipment may be returned to the Merchant.

In cases of repeated cash-on-delivery orders that are not collected without a valid reason, Bultik reserves the right to restrict the respective customer's ability to use cash on delivery for future orders, to the extent permitted by law.

VIII. RIGHT OF WITHDRAWAL AND RETURNS

Article 20. Where the User qualifies as a consumer under applicable legislation, they have the right to withdraw from a distance contract within the period prescribed by law, without providing a reason, except in cases where the law provides for an exception.

For goods, the standard period for exercising the right of withdrawal is 14 days, starting from the date on which the goods are received by the User or by a third party designated by the User.

Article 21. To exercise the right of withdrawal, the User must notify Bultik by means of an unequivocal statement sent to:

Article 22. When exercising the right of withdrawal, the User must return the goods within the period prescribed by law.

The direct costs of returning the goods are borne by the User, unless otherwise provided by law or expressly offered by Bultik.

The User is responsible for any diminished value of the goods only where it results from handling the goods beyond what is necessary to establish their nature, characteristics, and proper functioning.

Article 23. Where the right of withdrawal has been validly exercised, the Merchant shall refund the amounts due in accordance with applicable legislation.

The Merchant may withhold the refund until the goods have been received back or until the User provides evidence that the goods have been sent back, where permitted by law.

IX. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

Article 24. The right of withdrawal does not apply in cases expressly provided for by law.

This may include, among other statutory exceptions, goods made to the User's specifications or according to the User's individual requirements, where the legal conditions for such an exception are met.

The fact that a product was purchased online does not, in itself, remove the right of withdrawal.

X. COMPLAINTS AND CONFORMITY OF GOODS

Article 25. The User has the right to submit a complaint in the event that the goods received do not conform to the sales contract, in accordance with applicable legislation.

When submitting a complaint, it is recommended that the User provide:

  • the order number;

  • the product to which the complaint relates;

  • a description of the problem;

  • name and contact details;

  • photographs or other evidence, where applicable.

Article 27. Complaints shall be reviewed and resolved in accordance with applicable consumer protection legislation.

The right to make a complaint in the event of an actual lack of conformity of the goods is not restricted by these Terms and Conditions.

XI. INTELLECTUAL PROPERTY

Article 28. The content of bultik.com, including texts, photographs, images, graphics, logos, designs, and other materials, is protected by applicable intellectual property legislation where the relevant rights belong to the Merchant or have been granted to the Merchant for use.

Unauthorised copying, reproduction, publication, distribution, or commercial use of protected content without the necessary permission is prohibited.

XII. LIABILITY

Article 29. Bultik makes reasonable efforts to ensure that information regarding products, prices, and availability is accurate and up to date.

Technical, typographical, or other obvious errors may occur.

Article 30. The Merchant shall not be liable for temporary unavailability of the website due to technical issues, maintenance, actions of third-party service providers, or other circumstances beyond the Merchant's reasonable control.

XIII. CHANGES TO THE TERMS AND CONDITIONS

Article 31. The Merchant may update these Terms and Conditions in the event of changes in legislation, the operation of the online store, the services offered, or for other justified reasons.

For each individual order, the Terms and Conditions in force at the time the order was placed shall apply, unless a mandatory provision of law provides otherwise.

XIV. APPLICABLE LAW

Article 32. Any matters not governed by these Terms and Conditions shall be subject to the applicable laws of the Republic of Bulgaria and applicable European Union law.

Disputes between the Merchant and the User shall first be resolved through good-faith negotiations, where possible. If no agreement can be reached, disputes shall be resolved in accordance with the procedures provided for under applicable law.
